In accordance with section 199B of the Administration Act, the Department of Education and Training (the department) publishes a list of services that have been sanctioned under section 195H and/or suspended under section 197A of that Act (or sanctioned under section 200 and/or suspended under section 201A prior to 2 July 2018). Information published on this page only relates to those enforcement actions permitted to be published under the Family Assistance Law (FAL).
The FAL that existed before 2 July 2018 is saved under items 8 and 10 of Schedule 4 to the Family Assistance Legislation Amendment (Jobs for Families Child Care Package) Act 2017 in relation to things done or matters arising before 2 July 2018 (referred to as the "continued law"). These provisions save, among other matters, the law that relates to provider's non-compliance arising before 2 July 2018. These conditions therefore form part of the "continued law". A provider may be sanctioned on the basis of a breach of a condition for continued approval that applied in respect of the provider of the child care service under the FAL.
Part 7 of the Child Care Subsidy Minister's Rules 2017 contains transitional rules made under item 12 of Schedule 4 to Family Assistance Legislation Amendment (Jobs for Families Child Care Package) Act 2017, with the effect that a sanction is to be imposed under new section 195H of the Administration Act from 2 July 2018 and can be applied with respect of non-compliance arising under the repealed legislation. Due to the July 2018 changes, legislative references used in this register may be noted, "as saved".
The department established the Child Care Enforcement Action Register because it considers that information on sanctions should be available to the public. Information about the responsibilities and obligations of approved child care services and the FAL can be found on the department's website.
